The onus is now on every practising solicitor to display and confirm they are achieving continuining competence. The SRA toolkit gives helpful advice on how to approach this. An important part of this is "reflection" and this idea is discussed in Episode 19.
Some of you will be naturally reflective and find it easy. Some who are more action orientated may find it more difficult and frustrating.
1. Take a moment to reflect on whether you currently do reflection, because probably you do. Is there a time in the day, perhaps on your way back from work, late evening or early morning when you think about what you've done and how well it went. However informal that might be, it is the starting point for reflection.
2 Taking reflection a step further, you would pinpoint particular actions you took (whether that's drafting a document, or speaking to a client on the phone or having a discussion with a colleague) and highlighting what went well and what did not go so well. NB don't just focus on things that you think have gone wrong, we need to learn from our successes as well as our mistakes.
3. For incidents that you think are particularly important whether that was because they showed you working really well, or not performing well, you could go into more detail about the context, eg was it on the phone, in the office, what did you actually do or say and what worked or didn't work. Why was that? What would you do, the same or differently in similar circumstances next time.
4. If all that sounds detailed, or cumbersome, that's why people have a learning log and write some of this down. And in fact, the SRA needs physical evidence of reflection and a learning log, or whatever you choose to call it, is where you find it.
